Terms and Conditions for AVAA FIN (Kiwimoney Financial Technology Pvt Ltd)

1. Introduction These Terms and Conditions govern the relationship between AVAA FIN, operated by Kiwimoney Financial Technology Pvt Ltd, and its franchisees/customers. By entering into an agreement with AVAA FIN, you agree to abide by these terms.

2. Franchisee Obligations

   • Franchisees must comply with the operational guidelines provided by AVAA FIN.
   • Franchisees are responsible for paying the franchisee fee and other associated costs on time as outlined in the agreement.
   • Franchisees are required to maintain confidentiality regarding proprietary software, business models, and customer data.

3. Payment Terms

   • Franchisees are required to pay the full amount of the franchisee fee as agreed in the contract.
   • A token payment may be accepted to reserve a franchise, with the balance payable before the delivery of services or equipment.
   • Any delays in payment may result in a suspension of services and may incur additional charges or penalties.

4. Delivery of Services and Equipment

   • Upon receipt of the full payment, AVAA FIN will deliver the required software and equipment to the franchisee within 10 business days.
   • Any delays caused by external factors will be communicated to the franchisee in advance.

5. Use of AVAA FIN Services

   • Franchisees are authorized to use AVAA FIN's software and services only for the purposes outlined in the franchise agreement.
   • Any unauthorized use of AVAA FIN’s systems may result in termination of the franchise agreement and legal action.

6. Termination of Agreement

   • Either party may terminate the franchise agreement under the terms outlined in the contract.
   • In the event of termination, the franchisee must return any proprietary software and equipment provided by AVAA FIN.

7. Liability

   • AVAA FIN shall not be liable for any indirect, incidental, or consequential damages arising out of the use of its services or software.
   • Franchisees agree to indemnify AVAA FIN against any losses or damages arising from their operation of the franchise.

8. Confidentiality

   • Both parties agree to maintain the confidentiality of any sensitive information shared during the term of the agreement, including business processes, client data, and proprietary software details.

9. Governing Law

   • These Terms and Conditions are governed by and construed in accordance with the laws of India, and any disputes arising will be subject to the exclusive jurisdiction of the courts in [jurisdiction].

10. Amendments

• AVAA FIN (Kiwimoney Financial Technology Pvt Ltd) reserves the right to amend these Terms and Conditions at any time, with notice provided to franchisees/customers in writing.

By entering into a relationship with AVAA FIN, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
